Peña Nieto proposes that Head of the Attorney General's Office be appointed by Senate

On February 10 th , 2014 was published in the Federal Official Gazette the constitutional amendment in political-electoral matters that determined the transformation of the Procuraduría General de la República into the Fiscalía General de la República. This amendment granted constitutional autonomy to the Fiscalía General de la República, eliminating its dependence on the Federal Executive.


In the transitional provisions of the 2014 amendment, was determined that the transformation of the Procuraduría General de la República into the Fiscalía General de la República will depend on the issuance of the Internal Organizational Law of the Federal Attorney General’s Office and the "express declaration" of entry into force to be made by the Mexico’s Federal Congress. Both, the legislation and the express declaration of entry into force, have not been issued.


Within the same transitional articles was dictated that the Procurador General de la República who is in office at the time of the express declaration of entry into force, would be designated, by constitutional mandate, as Fiscal General de la República, for a period of 9 years.


On October 25 th , President Enrique Peña Nieto appointed Raúl Cervantes Andrade as Procurador General de la República; his appointment was unanimously ratified by the Senate on October 26 th .
