As you may recall, on June 8, 2023, NOM-037-STPS-2023 issued by the Ministry of Labor and Social Welfare (“STPS”) was published in the Federal Official Gazette (“DOF”).
This Standard establishes the health and safety conditions for workers under the Teleworking modality, in order to prevent accidents and illnesses, as well as promote a safe and healthy environment in the place of work (hereinafter “NOM-037”).
According to the publication in the DOF, NOM-037 will enter into force 180 calendar days after the publication date. In other words, as of December 5, 2023, companies and employees under the Teleworking modality must comply, without exception, with the obligations established by NOM-037.
Likewise, we remind you that compliance with this Standard may be verified in the inspections carried out by the STPS, and failure to comply could result in the imposition of fines.
